Terms of Use
The terms that govern your use of the Fundur website and application process — including how we describe our marketplace role, what we can and can't promise, and where a lender's own terms take over.

1. Acceptance of Terms
By accessing or using the Fundur website at fundur.com (the “Site”), you agree to these Terms of Use (these “Terms”). If you do not agree, please do not use the Site.
These Terms apply to the entire Site, including pages describing Fundur's financing marketplace, educational content such as our Business Loan Guide, and the application process.
If you submit a financing application through the Site, you may be asked to provide additional authorizations and consents specific to that application — for example, consent to receive text messages, or permission to share your application with financing providers. Those consents are presented to you at the time you submit your information and are governed by the terms presented at that time, together with our Privacy Policy and, where applicable, our SMS Terms & Conditions. Agreeing to these Terms by using the Site does not, by itself, constitute consent to receive marketing text messages; text-message communications are governed separately as described in Section 10.
2. About Fundur
Fundur is a business financing marketplace, not a direct lender. Fundur is a trade name (DBA) of Norman Advisors LLC, a New York limited liability company. In these Terms, “Fundur,” “we,” “us,” and “our” refer to Norman Advisors LLC, operating under the Fundur brand, unless the context requires otherwise.
Fundur helps business owners compare financing options across a network of third-party lenders. When you submit an application through the Site, a Fundur advisor reviews it and works to identify which lenders in Fundur's network are likely to be a fit for your business. Fundur does not itself extend credit, underwrite applications, or make lending decisions — those decisions, and the resulting rates, terms, and funding, belong to the lender that ultimately offers you financing.
Nothing in these Terms, or elsewhere on the Site, should be read to describe Fundur as a lender, a creditor, a bank, or a guarantor of any financing product.
3. Eligibility & Use of the Site
The Site is intended for business owners and authorized representatives of a business who are researching or seeking business financing, and for general visitors researching how business financing works.
You may use the Site only for lawful purposes and in accordance with these Terms. By submitting an application through the Site, you represent that you are at least 18 years old, that you have the authority to submit information on behalf of the business named in the application, and that the information you provide is accurate to the best of your knowledge.
Fundur does not independently verify your authority to act on behalf of the business you identify. If you submit information on behalf of a business, you are responsible for having the right to do so.
4. No Guarantee of Financing
Using the Site, submitting an application, or speaking with a Fundur advisor does not guarantee that you will be approved for financing, receive an offer, or receive any particular amount, rate, term, or funding speed.
Fundur does not guarantee:
- approval by any lender in our network;
- that you will receive an offer of financing;
- a specific loan amount, rate, term, or fee structure;
- a specific funding date or funding speed; or
- that any particular lender will review or consider your application.
Whether you are approved, and on what terms, is decided by the lender, based on that lender's own underwriting criteria applied to your business.
5. Financing Information
Rates, terms, funding amounts, and other financing details described on the Site — including on our product pages, Rates & Costs, Business Loan Requirements, and Business Loan Guide — are general and illustrative. They are intended to help you understand how a type of financing typically works, not to describe an offer available to you personally.
Actual rates, terms, fees, and funding amounts depend on the lender, your business's financial profile, the purpose of the financing, and other factors specific to your application. Where the Site describes typical ranges — for example, typical rates, terms, or time-in-business expectations — those ranges reflect general patterns we've observed across our lender network and are not a promise about what any lender will offer your business.
6. Third-Party Lenders & Financing Providers
When you apply through Fundur, your application may be shared with one or more third-party lenders in Fundur's network, consistent with our Privacy Policy. Each lender independently:
- sets its own eligibility requirements;
- underwrites and decides whether to approve your application;
- sets the rate, term, fees, and other conditions of any financing it offers; and
- is responsible for its own compliance with the laws that apply to its financing products.
Fundur does not control, and is not responsible for, a lender's underwriting decisions, the accuracy of a lender's offer, or a lender's conduct once your application is in that lender's hands. If you accept an offer from a lender, your financing agreement is with that lender, not with Fundur, and that lender's own terms and disclosures govern the financing itself.
7. No Financial, Legal, Tax, or Accounting Advice
Content on the Site — including our Business Loan Guide, Rates & Costs, Business Loan FAQs, Compare Financing, and our industry and state pages — is provided for general educational purposes. It is not financial, legal, tax, or accounting advice, and it is not a substitute for advice from a qualified professional familiar with the specifics of your business.
Fundur advisors can help you understand and compare financing options, but they are not acting as your financial, legal, tax, or accounting advisor. Before making a financing decision, consider speaking with your own accountant, attorney, or financial advisor.
8. Your Information & Accuracy
When you use the Site, including when you submit an application, you agree to provide accurate, current, and complete information, and confirm that you have the authority to submit that information on behalf of your business. You are responsible for keeping the contact information you provide — such as your phone number and email address — up to date so that Fundur and its lenders can reach you about your application.
Providing inaccurate or incomplete information may delay your application, affect the offers you're shown, or result in a lender declining your application. How Fundur collects, uses, and shares the information you submit is described in our Privacy Policy.
9. Privacy
Our Privacy Policy explains what information Fundur collects, how we use it, and when it may be shared with lenders in our network. The Privacy Policy is incorporated into these Terms by reference. Please review it before using the Site or submitting an application.
10. Communications
By submitting an application, you provide a phone number and email address so that a Fundur advisor can contact you about that application.
Additional communications — including text messages — may require a separate consent, presented to you at the point you submit that information. Text-message communications from Fundur are governed by the consent presented on our application form at the time you apply and by our SMS Terms & Conditions, which describe the type of messages you may receive, applicable message and data rates, and how to opt out, including by texting STOP to any message you receive.
If a lender or other financing provider in our network contacts you after your application has been shared with them, that lender's own communications and consent practices apply — not Fundur's.
11. Intellectual Property
The Site — including its text, design, graphics, logos, and the Fundur name and marks — is owned by Fundur or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and print pages of the Site for your own personal or internal business use in connection with evaluating financing, but you may not copy, reproduce, republish, distribute, or create derivative works from the Site's content for any other purpose without Fundur's prior written permission.
The Site may include photography, icons, or other assets licensed from third parties. Those assets remain the property of their respective owners.
12. Acceptable Use
When using the Site, you agree not to:
- use the Site for any unlawful purpose, or submit an application containing information you know to be false;
- attempt to gain unauthorized access to the Site, its systems, or any account or data on it;
- interfere with or disrupt the Site's operation, including through malicious code, excessive automated requests, or similar means;
- scrape, harvest, or misuse content from the Site beyond ordinary browsing; or
- impersonate another person or business, or submit an application on behalf of a business you are not authorized to represent.
13. Third-Party Websites
The Site may link to websites operated by third parties, including lenders, partners, or informational resources. Fundur does not control those websites and is not responsible for their content, accuracy, or practices, including their privacy practices. Visiting a linked website is at your own discretion, and that website's own terms and privacy policy will apply.
14. Changes to the Site
Fundur may update, modify, or discontinue any part of the Site, including its content, features, or availability, at any time. We aim to keep the Site accurate and available, but we do not guarantee that the Site will be uninterrupted, error-free, or available at all times.
15. Disclaimer of Warranties
The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Fundur disclaims all warranties of any kind regarding the Site, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Fundur does not warrant that the Site will be error-free, secure, or uninterrupted, or that any information on the Site — including the financing information described in these Terms — is complete or current for your specific situation. Where the Site includes information provided by or about third-party lenders, Fundur does not warrant the accuracy or completeness of that information, which remains the responsibility of the lender that provided it.
16. Limitation of Liability
To the fullest extent permitted by law, Fundur and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including for lost profits, lost revenue, lost data, or business interruption — arising out of or related to your use of the Site, your application, or your interactions with any lender or other financing provider, even if Fundur has been advised of the possibility of such damages.
Nothing in this section limits any liability that cannot be limited or excluded under applicable law.
17. Indemnification
You agree to indemnify and hold harmless Fundur and its officers, employees, and agents from and against any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your misuse of the Site; (b) your violation of these Terms; or (c) information you submit that you know to be false.
This section does not require you to indemnify Fundur for Fundur's own negligence, misconduct, or violation of law, or for the ordinary outcome of a financing decision made by a lender.
18. Dispute Resolution
These Terms do not require binding arbitration and do not include a class-action waiver. If a dispute arises between you and Fundur relating to these Terms or your use of the Site, either party may pursue that dispute in court, subject to the governing law and venue described in Section 19.
Before filing a claim, we encourage you to contact us at info@fundur.com so we can try to resolve the issue informally. This is not a mandatory step, and it does not limit either party's right to pursue a claim in court at any time.
19. Governing Law & Venue
These Terms, and any dispute arising out of or relating to these Terms or your use of the Site, are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. This choice of governing law does not deprive you of any protection afforded by provisions of law that cannot be waived by agreement under the law that would otherwise apply.
Any legal action or proceeding arising out of or relating to these Terms or your use of the Site will be brought in the state or federal courts located in the State of New York, and you consent to the jurisdiction of those courts. Nothing in this section prevents either party from seeking relief in another forum where required by applicable law.
20. Changes to These Terms
Fundur may update these Terms from time to time. When we do, we will update the “Last Updated” date above. Continued use of the Site after an update means you accept the revised Terms. We do not currently send individual notices for every update to these Terms, so checking this page periodically is the best way to stay current.
